1.About SlabBid
SlabBid (“SlabBid,” “we,” “us,” or “our”) operates the website at slabbid.com (the “Site”) and provides an online service that lets collectors get cash offers for PSA graded sports cards (collectively, the “Service”). These Terms of Service (the “Terms”) form a binding agreement between you and SlabBid.
We may update these Terms from time to time. When we do, we will update the “Last updated” date above and post the new version on this page. Continued use of the Service after a change becomes effective means you accept the revised Terms. If you do not agree, stop using the Service.
2.The Service
The Service works like this:
- You enter a PSA cert number and card details (and, where requested, photos) through the Site.
- We generate a non-binding cash offer based on the information you submit and recent comp sales data.
- If you accept, we send you a prepaid shipping label so you can send the card to us.
- We inspect and verify the card on arrival and confirm or revise our offer based on the actual item.
- If you accept the final offer, we send payment. If you decline, we return the card to you at no charge, except as set out in these Terms.
You are solely responsible for the accuracy of everything you tell us about your card.
3.Eligibility and Account
By using the Service, you represent and warrant that:
- You are at least eighteen (18) years old and have the legal capacity to enter into these Terms.
- You will provide accurate, current, and complete contact and identification information, and keep it up to date.
- You are responsible for any activity that occurs through your account, and you will keep your login credentials confidential.
- You will notify us at support@slabbid.com promptly if you suspect unauthorized access to your account or submissions.
We may refuse, suspend, or terminate the Service for any user at our discretion, including if we believe you have violated these Terms, submitted counterfeit or stolen items, provided false or misleading information, or used the Service in a way that could harm us or another user.
4.Offers, Final Pricing, and Payment
Initial offer. The offer we generate before we have your card in hand is non-binding and based entirely on what you submit. It assumes the card matches its PSA record and any photos you provide. Initial offers are valid for ten (10) days from the day they are issued unless we say otherwise.
Verification and final offer. When your card arrives, we inspect it and verify it against the PSA database. We may revise the initial offer if (a) the actual card differs from what was submitted, (b) the slab shows signs of tampering or damage we could not see in photos, (c) authenticity cannot be confirmed, (d) the cert number does not match the card, or (e) we otherwise determine in our reasonable discretion that the price should change. We typically issue a final offer within one to two (1–2) business days of receipt.
Acceptance and payment. You can accept or decline the final offer. If you accept, we initiate payment to your chosen method, generally within one (1) business day of acceptance. Available payment methods, processing times, and any payout fees are shown during the transaction. If you decline, see Section 7 for return shipping.
Inactive submissions. If you do not respond to a final offer within thirty (30) days after we notify you, we may treat the offer as accepted, return the card at our discretion, or charge reasonable storage fees as permitted by law.
5.Your Representations About the Card
By submitting a card, you represent and warrant that:
- You are the legal owner of the card or have full authority to sell it on the owner's behalf.
- The card is genuine, has not been tampered with, and the PSA slab and label have not been altered, swapped, or counterfeited.
- All information, photos, and cert numbers you provide are accurate, current, and not misleading.
- The card is free of liens, claims, security interests, or other encumbrances, and you can transfer clean title to SlabBid.
- You will ship the exact card you described and will not substitute or alter it after the offer is generated.
You agree to disclose anything that could affect the card’s value, including but not limited to cracked or damaged slabs, labels with errors or repairs, and any handling that would matter to a reasonable buyer.
6.Eligible Cards and Authentication
Eligibility. The Service is currently for cards graded by PSA in their original, unaltered slabs. We may add or remove eligible grading services, sets, or categories at any time, and we may decline any submission for any reason.
Verification. All cards are subject to verification by SlabBid, including but not limited to checks against PSA’s public database, physical inspection of the slab, and any other authentication steps we consider appropriate.
Counterfeit, tampered, or stolen items. If we determine that a submission is counterfeit, tampered with, or otherwise inauthentic, or that it has been reported as stolen, we may (a) refuse to return the item, (b) cooperate with PSA, law enforcement, or other authorities, and (c) charge a verification fee of up to one hundred dollars ($100) to cover our costs. We will tell you before charging this fee, and you authorize us to deduct it from any return-shipping or other amounts owed to you.
Prohibited submissions. You may not submit (a) counterfeit or replica cards or slabs, (b) stolen property, (c) cards subject to legal restrictions on sale, (d) cards with significant undisclosed damage, or (e) anything that would violate these Terms or applicable law.
7.Shipping and Risk of Loss
Outbound shipping. We provide a prepaid, insured shipping label at no cost. You are responsible for packaging the card securely (rigid case, padding, and a sealed outer box are recommended) and dropping the package with the carrier within the time frame stated on the label. We recommend keeping a receipt of drop-off.
Risk of loss in transit to us. Until we receive and open the package at our facility, the risk of loss or damage in transit remains with you, the sender. If a shipment is lost or damaged in transit, we may help you file a claim under the carrier’s insurance, but recovery is not guaranteed and is subject to the carrier’s policies.
Risk of loss while we have the card. Once we receive and open the package, we assume the risk of loss while the card is in our possession during inspection, verification, and any holding period.
Return shipping. If you decline our final offer, we will return the card to you at no charge (subject to Section 6 for counterfeit or tampered items), generally within five to seven (5–7) business days inside the United States. We retain risk of loss until we hand the return package to the carrier; risk shifts back to you once it is in transit. Tracking is provided where available.
We use third-party carriers and cannot guarantee delivery times, tracking accuracy, or the availability of carrier insurance.
8.Fees
The Service is free to use for offers, free for outbound and return shipping (subject to Section 7), and we do not charge a commission on accepted offers. The only fees you may owe are:
- Verification fee. Up to $100 if a submission is counterfeit, tampered with, or otherwise inauthentic, as described in Section 6.
- Storage or handling fees. Reasonable fees for cards left unanswered or unclaimed beyond thirty (30) days after a final offer, as described in Section 4.
- Late payment. If any amount you owe SlabBid is past due, we may charge interest at the lesser of 1.5% per month or the maximum allowed by law, plus reasonable collection costs and attorneys' fees.
9.Your Content
When you submit photos, cert numbers, descriptions, messages, or other content (“Your Content”), you grant SlabBid a non-exclusive, worldwide, royalty-free, fully paid-up, sublicensable license to use, store, reproduce, modify, and display Your Content to (a) evaluate your card, (b) operate, support, and improve the Service, (c) detect fraud and verify authenticity, and (d) use anonymized or aggregated data for analytics, marketing, and product development. We will not use your name or likeness for marketing without your consent.
You represent and warrant that Your Content does not infringe any third party’s intellectual property, privacy, publicity, or other rights.
10.Intellectual Property
The Site and the Service — including all software, text, design, graphics, logos, and other content, and all related intellectual property rights — are owned by SlabBid or our licensors and are protected by U.S. and international copyright, trademark, and other laws.
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access the Site and use the Service for your personal, non-commercial use, in accordance with these Terms. You may not (a) copy, modify, or create derivative works of the Site or Service; (b) use our name, logo, or branding without our prior written permission; (c) scrape, crawl, or otherwise harvest data from the Site through automated means; (d) reverse engineer or attempt to extract source code from the Service; or (e) remove or obscure any proprietary notices. All rights not expressly granted are reserved.
11.Privacy
Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.
12.Prohibited Conduct
You agree not to:
- Provide false, inaccurate, or misleading information about yourself or any card.
- Submit counterfeit, tampered, stolen, or illegal items.
- Use the Service for any unlawful or fraudulent purpose, or to deceive SlabBid or another user.
- Interfere with, disrupt, or impair the Service or any servers or networks connected to it.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
- Impersonate any person or entity, or misrepresent your affiliation with anyone.
- Violate any applicable law, regulation, or third-party right, including intellectual property and privacy rights.
- Use the Service for resale or commercial activity without our prior written consent.
- Upload or transmit malware, viruses, worms, or other harmful code.
- Decompile, disassemble, or reverse engineer the Service or attempt to derive its source code.
13.Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. To the maximum extent permitted by law, SlabBid disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.
SlabBid does not warrant that (a) the Service will meet your requirements; (b) it will be uninterrupted, timely, secure, or error-free; (c) any offer will remain available; (d) any card will be accepted for purchase; or (e) data on the Site is accurate, complete, or current. Comp sales data and offer calculations are estimates, not guarantees of price or marketability.
14.Limitation of Liability
To the maximum extent permitted by law, SlabBid and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to the Service, whether based in contract, tort (including negligence), strict liability, or otherwise, even if SlabBid has been advised of the possibility of such damages.
SlabBid’s total liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the amount of the final offer SlabBid made for the card at issue, or (b) five hundred dollars ($500). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
15.Indemnification
You agree to indemnify, defend, and hold harmless SlabBid and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) Your Content or any submission you make; (d) any false or misleading information you provide; (e) your submission of a counterfeit, tampered, stolen, or illegal item; or (f) your gross negligence, fraud, or willful misconduct.
16.Dispute Resolution and Arbitration
Informal resolution. Before filing a claim, you agree to try to resolve the dispute by contacting us at support@slabbid.com and giving us at least thirty (30) days to respond.
Binding arbitration. Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this Section, except as noted below. The arbitration will be conducted in English, and the seat of arbitration will be Delaware (United States) unless the parties agree otherwise. Each party will bear its own costs except as the arbitrator orders.
Class action waiver. Disputes will be brought on an individual basis only. You waive any right to participate in a class, collective, or representative action.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect intellectual property rights.
17.Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to Section 16, any action that may be brought in court must be filed exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
18.Equitable Relief
You acknowledge that a breach of these Terms could cause irreparable harm to SlabBid that monetary damages alone would not adequately remedy, and that we may seek injunctive or other equitable relief without posting a bond, in addition to any other remedies available.
19.Changes to the Service
We may modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We are not liable to you or any third party for any change to or unavailability of the Service. Among other things, we may change (a) our pricing or valuation methodology, (b) eligible cards or grading services, (c) verification standards, (d) payment methods or timing, or (e) shipping procedures. We will use reasonable efforts to communicate material changes through the Site.
20.Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service immediately and without notice if (a) you breach these Terms, (b) we are required to do so by law, (c) we discontinue the Service, or (d) we determine termination is appropriate in our reasonable discretion.
On termination, your right to use the Service ends, any pending transactions will be completed or canceled at our discretion, and the provisions of these Terms that by their nature should survive — including Sections 5, 6, 8, 9, 10, 13, 14, 15, 16, 17, and 18 — will survive.
21.Geographic Limitations
The Service is intended for users located in the United States. We make no representation that it is appropriate or available outside the U.S. If you access the Service from elsewhere, you do so at your own risk and are responsible for compliance with local law.
22.Electronic Communications
By using the Service, you consent to receive communications from us electronically, including emails and notices about your transactions. You agree that any agreements, notices, and other communications we provide electronically meet any legal requirement that they be in writing.
23.Third-Party Services
The Service may link to or rely on third-party websites or services (for example, PSA verification, shipping carriers, and payment processors). We do not control those services and are not responsible for their content, terms, or practices. Your use of any third-party service is governed by its own terms and policies.
24.Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions remain in full force. The invalid provision will be modified to the minimum extent needed to make it enforceable while preserving its intent.
25.Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SlabBid regarding the Service and supersede any prior agreements or understandings.
26.No Waiver
Our failure to enforce any right or provision is not a waiver of that right. Any waiver must be in writing and signed by SlabBid.
27.Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer ours.
